Thomas George Booking Terms & Conditions 2006/07The ContractThe terms and conditions set out in the Booking Contract and Important Information together with your confirmation invoice form your agreement between Thomas George Limited and all those named on the booking on whose behalf the party leader is acting. A contract cannot be made for young persons unless one member of the party is at least eighteen years of age and is the lead name on the booking. The Confirmation When you have chosen your holiday, if we are able to meet your request we will confirm this to you over the telephone. However, the contract is not made until the date shown on our invoice. Only then does a contract exist between us. Quotations given over the telephone are always subject to written confirmation. Verbal descriptions, assurances and agreements can seldom be confirmed or amicably clarified in subsequent disputes and for this reason Thomas George Limited does not accept liability for them. If you wish to include any particular items within the contract we will gladly consider them, you should request them in writing and acceptance will be established only on dispatch of written confirmation of acceptance by Thomas George Limited. Once we have verbally confirmed your booking and received your deposit we will issue a confirmation invoice. If you do not receive this invoice within 14 days, please contact us to make sure that your booking has been confirmed by us. When you receive your invoice, please check all the details carefully to ensure they are correct, as this forms the basis of the contract between us. If there are any discrepancies, please bring these to our attention within 7 days of issue, otherwise we will assume the details shown are correct. Whilst we would not anticipate any pricing errors in the confirmation invoice, in the event of an obviously incorrect price, we will not be bound by this and will issue a revised invoice showing the correct amount. In the unlikely event we are unable to confirm your booking the following options will be available to you: (a) purchase another holiday at the current brochure selling price from us, or (b) accept a full refund of all monies paid You must notify us of which option you wish to accept within 7 days of the offer being made, otherwise we will assume you have chosen to accept the alternative holiday offered. Whichever option you choose, a confirmation invoice will be sent as soon as possible and, if you do not wish to proceed, we will refund all monies paid within 7 days. Prices The prices on the TGski website are in sterling. All accommodation is priced per person. Each person must pay the holiday price applicable to the dates and length of his individual holiday. VAT has been included in the price of all holidays. Telephone quotes are subject to written confirmation. Price Guarantee Once your holiday has been booked its price will not change even if the value of sterling falls. However, we do reserve the right to amend our prices at any time before you book. You will be advised of any revised price before you book. Payments A deposit of £100 per person and any insurance premiums are payable at the time of booking, and the full holiday cost is due eight weeks before departure. Payment may be made in cash, by cheque (made payable to ‘Thomas George Limited’) or by credit/debit card and, in the case of group bookings, there should be one single payment. If we are required to debit more than two credit cards in respect of a group booking, we reserve the right to levy an administration fee of £25 per booking. Should the deposit and/or full payment not be paid by the due dates, we reserve the right to cancel the booking and levy cancellation charges as laid out below. Any balance paid by credit card, where authorisation to debit the card is received after the due date specified on the invoice, will be subject to a 2% administration charge. Once we have sent your Confirmation and Invoice, no further reminder will be sent. However, if you let us know in writing that you want a reminder, we will send you one the week before your payment is due. Any money paid by you to a travel agent in respect of a booking with us is held by the agent on our behalf. Insurance It is a condition of booking that you and everyone in your party take the insurance offered by us or have an insurance which provides equal or greater cover under all sections. If you do not take our recommended insurance, you will be responsible for any costs that arise which would otherwise have been met had the TGski insurance been taken. If You Have To Change Your Booking Should you wish to make any alteration to your booking after it has been confirmed by us, but more than eight weeks before departure, we will comply with your request where possible only adding the alteration charges that we incur. If you are increasing the value of the total booking we will not charge an amendment fee; otherwise we will charge a fee of £25 per person per amendment, including the issue of a new ticket owing to a name change after tickets have been sent to the client. Simple name changes made more than four weeks prior to departure will be charged at the rate of airline charge fees. Other amendments requested within eight weeks of departure may result in cancellation charges as laid out below. If You Have To Cancel Your Booking Should you or any member of your party need to cancel a booking, cancellation charges will be made. All cancellations must be notified to us in writing by the person who signed the Booking Form. The deposit and any insurance premiums paid will be forfeited in all cases and, depending on when the cancellation is sent to us, the following charges (expressed as a percentage of the total holiday cost) will be made:
If no written notice of cancellation is received and you do not travel, cancellation will be deemed to have been effected on the day of departure. We reserve the right to re-sell any part of a cancelled holiday and this does not affect our right to levy cancellation fees. Please note that if you make a claim against your insurers the cancellation charges must be paid to us and then the cost reclaimed by you from the insurance company. A Cancellation Invoice can be sent only to the person who signed the Booking Form. If the size of your party reduces we will recalculate the cost of the holidays of those still traveling. If this means that the chalet is under-occupied, you may have to pay empty bed supplements. Any additional costs for the remaining party are not covered by the cancellation insurance arranged by us. If We Have To Change Your Booking It is most unlikely that we will have to make changes to your holiday but, having made arrangements many months in advance of your traveling, we reserve the right to do so. If we do have to alter your holiday in any way, we will inform you of the alteration as soon as possible. In the case of a major alteration we will offer you the choice of a holiday of at least comparable standard or a full refund. A change in flight departures of less than twelve hours, in carrier or type of aircraft would not constitute a major alteration by us, nor would flight delay. Children You must inform us at the time of booking if there are children (aged 16 or under) in your party, and give us the age they will be on the final day of your holiday. If a child has his/her second birthday during the holiday he/she will be invoiced as a child rather than an infant. Complaints Should you have any complaint or difficulty concerning your holiday we would ask you to discuss this with our representatives in Morzine. Your Behaviour On The Skiing Holiday You undertake to behave in such a manner as not to disrupt the enjoyment of others, both on the journeys to and from Morzine and in the resort itself, and undertake not to prejudice our reputation with our customers, the owners of our accommodation or our suppliers. The holiday of any Client or Party in breach of this clause may be terminated immediately and we will have no further contractual obligations towards him or them. In addition we reserve the right to recover in the resort the cost (or estimated cost if an actual cost is not yet known) of any loss, damage or breakage caused by you. We cannot accept responsibility for the actions of any Clients or be held liable for any claims made against them. Passports All clients must be in possession of a valid passport along with all necessary visas and permits to allow entry into France or Switzerland and to allow re-entry into the UK. Any costs or fines incurred due to any Client’s failure to comply with any regulations will be passed on to the person who signed the relevant Booking Form. Health Requirements At the time of publication, there were no specific vaccinations for travelling to France or Switzerland. For up-to-date information you are advised to refer to the Dept of Health leaflet Travellers’ Guide to Health, available from your GP, a travel clinic or by calling the Health Literature line on 0800 555777. Our Liability In all the arrangements we have made for your holiday we have taken reasonable steps to ensure that the suppliers of the services used are of an acceptable standard. However, we would point out that we do not own or control the organisations providing transport or accommodation for your holiday. We accept responsibility for the services we have contracted to provide except where the services in question consist of carriage by air or land, the liability for which shall be further limited in the manner provided by international conventions for air or land carriers. We cannot accept liability where the provision of services is interrupted by reason of force majeure: war, threat of war, riot, civil strife, industrial dispute, closure or congestion of airports or airways, technical or other problems to transport, terrorist activity, natural or nuclear disaster, fire or adverse weather conditions. If you suffer personal injury or death from any activity which is not part of your holiday booked with us but occurs during the holiday, we will not be liable for any compensation. This is at our discretion. |
